Court sentences son to death by hanging for killing his father inside Mosque

A middle aged man, Umaru Muhammadu Jauro Ori, in Mai’aduwa​ ​​ Village of Misau local government area in the state has been sentenced ​ ​​to death by hanging by the Bauchi State High Court Number Five presided over by Justice Aliyu Baba Usman for​ ​​ killing his biological father inside Mosque.In his judgment, Justice Usman said​ ​​ he listened to both sides,  the prosecution and the defence counsel led by Barrister Chukwumeka Ikwazu and​​ after listening to both sides​​ “the death of the victim was as result of the act of the accused and the prosecution counsel has proved their case beyond reasonable doubt, thereby​ ​​ found the accused culpable of homicide punishable with death under section 221 of the Bauchi State laws, I hereby sentenced him to die by hanging”.

According to him, the Chief State Counsel, Hussein Ishaq Magaji, told the court that the accused went in to a Mosque in Mai’aduwa Village and stabbed his father with a cutlass on his head and back as a result he sustained serious injuries and was rushed to the Misau General Hospital where he died the following day from the wounds of the attack contrary to section 221 of the Penal Code laws.

The Judge said the accused denied and pleaded not guilty to the offence during trial The Prosecution counsel brought​ ​10 witnesses in their separate statements recorded by the Police during investigation which were attached to the documents before the court, Junior brother of the deceased 70 year old Umar Mohammed Jatau and Junior brother of the accused, 26 year-old Ibrahim Muhammadu Jauro Ori stated that the suspect has problem with their father and themselves.

According to the witnesses, they said that the deceased separate their food with his Junior Brother Ibrahim and he gave each one of them his farm and after he left their village for over 10 months no one knows his whereabouts until the day he came and entered mosque. While they were praying, he stabbed their father on his head and back and the father fell down.

They said that youths in the area pursued him and arrested him because he ran away; they took him to the Police and took the deceased to the Hospital where he died while receiving treatment, his body was released to them and he was buried according to Islamic rights.

The suspect’s recorded statement by the Police said he has a wife and three children; two males, one female and he killed his father because his father separated him and his wife when he travelled out to open his eyes and stayed for a long time. The deceased divorced his wife, presently he has no wife, secondly his father separated him with his two brothers, “we are not like before after our father gave each one of us his farm”.

Umaru said when he returned, he took machete and entered mosque and stabbed his father on his head and back; “he fell down, when I run away, the youth pursued me and arrested me; they beat me mercilessly and injured my right fingers”.

“We took our father to Hospital and he died while receiving treatment, I have never killed a human being, I am not an armed robber and this is the first time I killed a human being”, the suspect stated.
